Random Drawing Rules

- GENERAL DESCRIPTION
Belcaro Group, Inc, located at 7100 E Belleview Ave, Greenwood Village, CO 80111 is the Sponsor of the Pick Your Present Game series of fifteen daily random drawings (the "Daily Random Drawings") and one grand prize drawing ("Grand Prize Drawing"), both of which registered ShopAtHome.com users can enter up to once per day by playing ShopAtHome.com's Pick Your Present (PYP) games during the designated entry periods (each an "Entry Period," according to the Entry Period schedule below). The PYP Game Random Drawing promotion (the "Promotion") begins 12:01 AM November 28, 2008 and ends 11:59 PM December 12, 2008 (the "Promotion Period"). The Grand Prize Drawing will take place on December 15, 2008. For purposes of these Rules, all times are Mountain Time (MT).
- ELIGIBILITY
Open to legal residents of and who are physically residing in the 50 United States and the District of Columbia who are 18 years of age or older as of November 28, 2008. Employees of Belcaro Group, Inc. and members of their immediate families are not eligible. Belcaro Group, Inc. reserves the right in its sole discretion to disqualify a participant who fails to comply with these Rules, who is found tampering with the entry process or who attempts to enter the contest in any manner or through any means other than described in these Rules. This Promotion is subject to all federal, state and local laws and regulations. Void in Puerto Rico and wherever prohibited by law.
- HOW TO ENTER
Fifteen Daily PYP Random Drawings (one per day November 28, 2008 - December 12, 2008)
a) Go to the URL http://www.shopathome.com/ and click on http://discounts.shopathome.com/games/pick-your-present.aspx;
b) Participants must be registered users of ShopAtHome.com in order to play, but will be given an opportunity to register when they enter the Site.
c) Registration requires submission of an email address , first name, and zip; and agreement to the website Terms of Use at http://www.shopathome.com/pages/membership-agreement.aspx;
d) Participants must verify address after completion of game to be entered into the applicable Daily Random Drawing, and to play the PYP game;
e) Participants may play PYP games one time per Entry Period and will be entered into the Daily Random Drawing once per Entry Period.
One Grand Prize Drawing (December 15, 2008)
Participants will automatically be entered in the Grand Prize Drawing for a $1,000 shopping spree each time Participant is entered into a Daily Random Drawing.
In addition, up to 25 additional Bonus Entries into the Grand Prize Drawing will be randomly awarded during each Entry Period. Thus Participants may be entered a maximum of 26 times per ShopAtHome.com user account email address.

- WINNER SELECTION
a) There will be a maximum of 26 winners selected in each unique Daily Random Drawing from among all eligible entries received during the applicable Entry Period within 24 hours of the close of the applicable Entry Period. Prizes for each Random Drawing will be awarded throughout each 24-hour Entry Period. All entries into the Daily Random Drawings must be transmitted and received during the applicable Entry Period to be eligible for the applicable Daily Random Drawing.
b) The winners of each unique Daily Random Drawing will be notified immediately that they have won. Each winner has 5 minutes from the time of notification to verify their postal address. If the winner does not verify his/her postal address within that 5 minute period, the prize is returned to the unawarded prize list and another winner will be randomly selected to receive that prize.
c) There will be one (1) winner selected in a Grand Prize Drawing from among all eligible entries received during the Promotion Period on December 15, 2008 for a prize of one (1) $1,000 shopping spree at the ShopAtHome.com merchant selected by winner. The winner may select any ShopAtHome merchant which is active on ShopAtHome.com on the date of the drawing. Grand Prize will be in the form of a Gift Certificate for use at the chosen merchant's website. The total value of Grand Prize is $1,000. All entries must be transmitted and received during the Promotion Period (November 28 - December 12) to be eligible for the Grand Prize Drawing.
d) The odds of winning each individual random drawing depend on the number of eligible entries received.
e) No prize substitution is allowed except at the discretion of the Sponsor and Sponsor reserves the right to provide a substitute prize of approximately equal or greater value if the advertised prize becomes unavailable. Prizes are non-transferrable, except to a surviving spouse residing in the same household. Prize details including style, color, size and other details at Sponsor's sole discretion. Gift card increments at Sponsor's sole discretion. Gift card prizes subject to standard gift card terms and conditions.
- CONDITIONS OF PARTICIPATION
a) Use of multiple email addresses to enter is prohibited. Use of a false email address or account, or an incorrect mail address will disqualify an entry. Entry materials and/or data that have been tampered with or altered are void. Entries that are lost, late, misdirected, garbled, incompletely received, mutilated or illegible, for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion or incompatibility at Sponsor's Site or elsewhere, will not be eligible and Sponsor is not responsible for any technical problems related to online entries. Proof of sending will not be deemed proof of receipt by Sponsor.
b) Sponsor reserves the right to modify, suspend or terminate these random drawings in the event that infection by a computer virus or other technological impairment occurs; and/or if the random drawings cannot be conducted as planned by causes beyond the control of the Sponsor. In the event of such termination, winners for the current Daily Random Drawing at the time of termination as well as for the Grand Prize Drawing will be selected from among all valid entries received at the point in time when it is determined that the random drawings cannot be continued as planned.
c) All entries become the sole property of the Sponsor and will not be acknowledged or returned. Sponsor is not liable for lost, stolen, misdirected or late entries. Winners will be determined in random drawings conducted by Sponsor whose decisions are final and binding on all matters relating to the Promotion. Potential winners will be notified by email at the email address specified in participant's ShopAtHome.com user account . If potential winner does not reply to such notification within 5 minutes of notification, or if the notification is undeliverable, or if potential winner refuses the prize, is ineligible to accept the prize, or does not otherwise comply with these Rules potential winner will be disqualified and an alternate winner will be selected in a new random drawing from all remaining eligible entries.
d) All taxes on prizes and incidental expenses not mentioned herein are the responsibility of the winners, if applicable. Winners may be required to sign an affidavit of eligibility, a publicity release (where permitted by law), a liability release, and, if the prize has a value of $600 or more, an IRS form W-9. If any of the above required signed documents are not received by Sponsor within 10 days of Sponsor's date of notification to potential winners, an alternative winner will be selected as indicated above.
e) Winner's acceptance of a prize constitutes the grant to Sponsor of an unconditional right to use winner's name, address (city and state only), likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law.
f) Sponsor reserves the exclusive right to interpret all conditions relating to this Promotion.
- RELEASE
a) By entering, participants agree to be bound by these Rules and decisions of Sponsor and participants release Belcaro Group, Inc. and its respective directors, officers, employees, and agents from any and all liability resulting from participation in this random drawing promotion or the awarding, acceptance, use, or misuse of any prize awarded. Participants agree to be contacted by Sponsor or its agents by telephone, mail or email regarding this Promotion.
b) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this random drawing promotion but in no event attorneys' fees; and participant hereby waives all rights to claim punitive, incidental and consequential damages and rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
- OFFICIAL RULES/WINNERS' LIST REQUEST
To request the Winners' List, send a self-addressed, stamped envelope to be received by Sponsor by January 31, 2009 to: ShopAtHome, Attn: Pick Your Present Winners List, PO Box 173854, Denver, CO 80217-3854. Vermont residents may omit return postage.
- RESTRICTIONS
Belcaro Group, Inc. is not responsible for any late or lost entries, or malfunctions that may occur. By entering any of this random drawing promotion, participant acknowledges that he/she has read and agrees to all the Rules. Participants agree to release and hold harmless Belcaro Group, Inc. and each of its directors, officers, employees, agents, successors and assigns, from any damage, injury, death, loss or other liability that may arise from participant's participation in the Promotion, or the awarding, acceptance, use or misuse of any prize. All participants agree that U.S. law shall apply exclusively to this Promotion and that any dispute with respect to the Promotion shall be resolved in the federal or state courts located in Denver, Colorado.
