ShopAtHome.com Membership Agreement

ShopAtHome.com uses the power of its consumer membership base to negotiate sales commissions from both well-known national retailers and specialty boutiques (our "Affiliate Stores"). We share these commissions with our ShopAtHome.com Members.

To ensure that you, as a ShopAtHome.com "Member", fully understand what you will be paid for, when you will be paid, what rights you have as a Member and what our responsibilities are to you, we have created this Membership Agreement. This is a very important document. By enrolling in the ShopAtHome.com program, you agree that you have read, understood, and agreed with the following Membership Agreement and our Privacy Policy in its entirety, and consent to be bound by all said Terms and Conditions, including any updates thereto.

Terms and Definitions

The following terms are used throughout the Membership Agreement, and may be interpreted only according to the definitions given here. These terms are capitalized throughout the Membership Agreement to indicate to the reader that they have been specifically defined.

Affiliate Stores: The retailers/online stores that participate in the ShopAtHome.com Program, and are featured on ShopAtHome.com's Web site.

Corporate Partner: Any business entity that is formally associated with the ShopAtHome.com Program.

Member: Anyone who meets ShopAtHome.com's membership requirements and sets up a membership account with ShopAtHome.com.

Qualified Purchases: Purchases made by Members of ShopAtHome.com that earn Cash Back Rebates.

Cash Back Rebates: The commissions that Members of ShopAtHome.com earn via the purchase of goods and services or through participation in other facets of the ShopAtHome.com Program.

Cash Back Transactions: The section of your Member account that shows Cash Back Rebates accumulated, with adjustment for returned purchases and other such variables. The Cash Back Rebates account balance is the amount you will receive in the form of a check at the next payment date, assuming you have met the stated Cash Back Rebate minimum defined below and verified your mailing address.

Referral Commission: The credit to your Member account (currently $5.00) which is received when someone registers with ShopAtHome.com, earns their own Cash Back Rebate, and names you as the referring party.

Provisions of the ShopAtHome.com Program

Qualified Purchases, Credit Accrual and Payments To be eligible for Cash Back Rebates you must make a Qualified Purchase. In order to make a Qualified Purchase, you must satisfy the following criteria:

  • You must have cookies enabled on your Web browser.
  • You must make all Qualified Purchases by clicking on the Affiliate Store's link that appears on the ShopAtHome.com site, and be successfully connected to the Affiliate Store's site based on that click.
  • You must complete the Qualified Purchase during the same session immediately following the initial click-through to the Affiliate Store's site.

Our Select Rebates Software is designed to help ensure that you never miss a Cash Back Rebate if you forget to go to our ShopAtHome.com site prior to making a purchase on an Affiliate Store's site. When you enter the URL of an Affiliate Store's web site into your browser, the Software is designed to redirect your browser first to our ShopAtHome.com website, and then to the selected participating Affiliate Store's site. This process is designed to occur behind the scenes so you don't even know it is happening, and in a manner that does not interrupt your shopping experience. We strongly recommend that you download and install the Select Rebates Software, because without it if you do purchase from one of our Affiliate Stores without linking out from our Site first, you will lose your cash rebate! Determination of whether or not a purchase made through a ShopAtHome.com Affiliate Store is a Qualified Purchase is at the sole and absolute discretion of ShopAtHome.com. ShopAtHome.com is not responsible for tracking problems resulting from incorrect usage of the ShopAtHome.com site, from disabling cookies, or from any other failure of tracking mechanisms or the Select Rebates Software.

The appropriate credit information accrued from a Qualified Purchase from an Affiliate Store will be posted to your personal account within 5 business days from notice thereof to ShopAtHome.com by an Affiliate Store. Once we receive payment for your transaction and the return period defined by the Affiliate Store has expired, the Cash Back Rebates balance, adjusted for returns or other such variables, will be sent to you in the form of a check on the next scheduled payment date as set forth below.

Payments are distributed quarterly according to the following schedule:

*Cash Back Rebate checks are mailed on or around these dates.

All Cash Back Rebates are paid in U.S. dollars. You must have accrued $20 of Cash Back Rebates in your account for a check to be issued. If you have less than $20, the Cash Back Rebates amount rolls over to the next scheduled payment period. A $0.50 check-processing fee (the amount of which may be adjusted as needed by ShopAtHome.com) may be deducted from your account for postage and handling.

Prior to issuing your quarterly Cash Back Rebates check, ShopAtHome.com will email you to verify your contact information. You need to verify your information by a return E-mail prior to the deadline date specified in the verification email. If a verification email is not received back from you by the deadline date specified, your payment will automatically roll over to the next scheduled payment period.

Cash Back Rebates accrued to your account are subject to adjustment due to cancellations, returns and other events, including the Affiliate Store's failure to pay ShopAtHome.com its commission. ShopAtHome.com can make such adjustments to Member accounts at any time at its sole discretion. In the event you disagree with the adjustments made to your account, you need to let us know by email within thirty (30) days after the disputed adjustment has been posted to the Cash Back Rebates section of your account. After 30 days, your sole recourse is to terminate your account with ShopAtHome.com.

Members must contact ShopAtHome.com by email within sixty (60) days of original transaction date for any missing transaction(s) in the Member's account. ShopAtHome.com is not responsible for claims for any missing transaction(s) beyond sixty (60) days of original transaction date. The email should contain the Member's contact information, including postal address and email address used for the order, Affiliate Store name, transaction date/time and transaction total. ShopAtHome.com will adjust the Member's account within thirty (30) days if:

  • Transaction is a Qualified Purchase
  • Affiliate Store pays ShopAtHome.com for missing transaction(s)

ShopAtHome.com does not warranty, guarantee, or ensure the quality of any product or service requested from one of its Affiliate Stores. ShopAtHome.com is not responsible for changes to, or discontinuance of, any Affiliate Store, or for any effect on accrual of credits caused by such changes or discontinuance.

ShopAtHome's SelectRebates Intelligent Shopping Toolbar & Software

Our Shopping Toolbar is a free, easy-to-use shopping assistant that allows you to take the power of ShopAtHome with you anywhere on the Web. When you install the Toolbar, you are adding a whole new set of functions to your Web browser. For example, you can use the Toolbar to perform a ShopAtHome search from any site on the Web, or to search for specific products or coupons on any given page. The ShopAtHome Toolbar also offers users exciting features such as text alerts whenever store sites that YOU choose have a sale or special! Once you install the Toolbar, for ease of use it will be visible in your Web browser window whenever you are connected to the Internet.

The Toolbar functionality is dependent on our SelectRebates Software. This Software is installed as an integral part of the Toolbar. It is designed to help ensure that you never miss a Cash Back Rebate if you forget to go to our ShopAtHome.com site prior to making a purchase on an Affiliate Store's site. When you enter the URL of an Affiliate Store's web site into your browser, the Software is designed to redirect your browser first to our ShopAtHome.com Site, and then to the selected participating Affiliate Store's site. This process is designed to occur behind the scenes so you don't even know it is happening, and in a manner that does not interrupt your shopping experience.

We strongly recommend that you download and install the SelectRebates Intelligent Shopping Toolbar. This will allow you to receive up-to-the-minute alerts whenever your favorite shopping sites are running specials, and greatly enhance your shopping search capabilities. Additionally, if you do purchase from one of our Affiliate Stores without linking out from our Site first, the SelectRebates Software component of the Toolbar is designed to make sure you still get your cash rebate! If you decide at any time that you wish to remove the Shopping Toolbar and/or the SelectRebates Software from your computer, it is easy to do so from the Add/Remove function on your control panel. Please be aware that you may retain the SelectRebates Software and remove only the Toolbar, but if you remove the SelectRebates Software the Toolbar will automatically be removed as well. Referral Commissions

A referral commission, equaling $5 in accrued credits, may be earned when someone registers with ShopAtHome.com from our referral Email page, makes a Qualified Purchase to receive their own Cash Back Rebate, and names you as the referring party within 30 days of receiving the referral email. If the aforesaid referred individual is already a registered Member of ShopAtHome.com, no referral commission is earned.

Credits accrued from referrals are credited to your account once the referred individual has Credits accrued from referrals are credited to your account once the referred individual has made his or her own first Qualified Purchase, thus accruing their own Cash Back Rebate, through the purchase of goods and services. Therefore, your referral commission will not be credited to your account until the referred individual has earned his or her first Cash Back Rebate.

The referral commission program may be ended, commissions changed or the program modified in any way, at any time, and without notice, though all previously earned Referral Commissions will be paid per the above terms should this occur.

Members may not use unsolicited email, Usenet, or message board postings (SPAM) to gather referrals. Any use of SPAM to promote ShopAtHome.com, as determined at the sole and absolute discretion of ShopAtHome.com, will result in the termination of your account and forfeiture of all accrued credits. In addition, you may be subject to state and federal penalties or other legal consequences under applicable law.

ShopAtHome.com grants you a limited license to use the ShopAtHome.com trademark and trade name solely for the purpose of seeking legitimate referrals to the ShopAtHome.com program. The use of other trademarks on ShopAtHome.com, including but not limited to our Affiliate Stores, is prohibited without express written permission from ShopAtHome.comand/or the owner of any such trademark..

Member Rights and Responsibilities

You must be 18 years or older to participate in the program. You must be a legal resident of and maintain a physical address in the United States or Canada (no P.O. boxes).

You may maintain only a single account in the program at any given time. Any duplicate accounts are subject to cancellation and the potential loss of Cash Back Rebates.

No machines, scripts or automated services may be used in the Program. Any attempt to tamper, hack, spoof, copy, modify or otherwise corrupt the administration, security or proper function of any part of ShopAtHome.com will result in termination of membership, loss of Cash Back Rebates and Referral Commissions and bar you from future participation, and may result in legal action.

You agree to provide ShopAtHome.com with accurate contact information and keep it updated in order to facilitate the payment of your Cash Back Rebates and Referral Commissions.

Your password and account are personal to you and are non-transferable. You may not allow anyone else to use your password or account. ShopAtHome.com is entitled to act on instructions received under your password. ShopAtHome.com shall not be liable for losses that are incurred through the use of your password by a third party. Cash Back Rebates and Referral Commissions earned under the program cannot be assigned or transferred to a third party.

You may be taxed on your receipt of Cash Back Rebates and Referral Commissions depending on the amount you receive and the tax laws of your federal, state and local jurisdictions. You will be responsible for any and all tax liabilities arising out of your receipt of Cash Back Rebates and Referral Commissions.

You may cancel your Membership at any time by indicating your cancellation on your account information. Should you decide to cancel your membership or if there is no activity in your account for a period of 12 consecutive months, you will forfeit all earned Cash Back Rebates, all earned Referral Commissions, and bonusesany other account balances. If you choose to re-enroll at a later date, you will be assigned a new account number with a starting balance of $0.

ShopAtHome.com Rights and Responsibilities

ShopAtHome.com reserves the right to revise this Member Agreement, at its sole and absolute discretion, by updating this posting. The revised terms will take effect the date they are posted on the ShopAtHome.com site. Your continued enrollment in the ShopAtHome.com program shall be deemed to be your acceptance of the modified terms. Please review these posted terms on a regular basis.

Membership in the ShopAtHome.com Program is subject to the Terms and Conditions outlined in this Membership Agreement. ShopAtHome.com reserves the right to terminate your Membership for failure to comply with the said Terms and Conditions, any fraud or abuse relating to the accrual of Cash Back Rebates and Referral Commissions, or misrepresentation of any information provided to ShopAtHome.com or its Affiliate Stores. If your membership is terminated by ShopAtHome.com, ShopAtHome.com may refuse to pay some or all of the amounts credited to your account if such amounts were earned in violation, or after violation, of this Member Agreement or were otherwise unlawfully obtained, including credits earned through any facet of the ShopAtHome.com Program. Should your account be terminated by ShopAtHome.com, you are prohibited from re-enrolling under a new account unless formally invited to do so by ShopAtHome.com.

ShopAtHome.com also reserves the right to terminate your account should it become inactive. An account is deemed to be inactive when no Qualifying Purchases have been made for a period of at least 12 months. In the event of termination, you will forfeit all previously earned, but not paid Cash Back Rebates, Referral Commissions, and any other account balances.

ShopAtHome.com utilizes the appropriate industry practices to safeguard the confidentiality of your account information and to prevent unauthorized access, maintain data accuracy, and ensure the correct use of information. However, no data transmitted over the Internet can be 100% secure. Consequently, while ShopAtHome.com makes every effort to protect your personal information, any information that you provide to ShopAtHome.com or its Affiliate Stores is transmitted at your own risk.

By joining the ShopAtHome.com program, you are agreeing to receive ShopAtHome.com notification and promotional emails, enewsletters and other email special offers. If you do not wish to receive these Emails, you may opt out at any time by updating your account information at Customer Care by clicking on the unsubscribe link on the email itself; clicking on the Edit My Profile link at the bottom of the Cash Back homepage; or clicking on the My Preferences link on the left side of the Cash Back homepage.

By joining the ShopAtHome.com program, you agree that you have reviewed and accepted our Privacy Policy. In addition, by joining ShopAtHome.com, you have authorized us to receive account information from any Affiliate Store including, but not limited to, information regarding Qualified Purchases such as the products ordered, the order number, the time and date of the Qualified Purchase, and the email address entered for the Qualified Purchase.

You, as a ShopAtHome.com Member, agree to indemnify and hold ShopAtHome.com, its parents, subsidiaries, affiliates, officers, directors and employees, harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising in any way out of your participation in the ShopAtHome.com program, the use of the SelectRebates Intelligent Shopping Toolbar, the violation of this Member Agreement by you, or the infringement by you, or other user of the program using your account, of any intellectual property or other right of any person or entity, or as a result of any threatening, libelous, obscene, harassing or offensive material contained in any Member communications.

ShopAtHome.com reserves the right to immediately terminate the ShopAtHome.com Program at any time with notice. You will have Thirty (30) days from the date notice of program termination is provided to redeem your Cash Back Rebates and Referral Commissions if, at the date notice of termination is given, your earned Cash Back Rebates and earned Referral Commissions equal or exceed $20. Notice of program termination shall be effective upon our sending such notice to the email address you provide to ShopAtHome.com during the registration process. To receive payment of your Cash Back Rebates and Referral Commissions you need to respond to the email sent to you by ShopAtHome.com regarding verification of your contact information and notification of program termination. Should you not respond to the aforementioned Email within 30 days of notification of program termination, you will forfeit any and all Cash Back Rebates and Referral Commissions that remain in your Member account. Notification of program termination shall be effective upon our sending such notice to the Email address you provide to ShopAtHome.com during the registration process.

Any disputes and/or claims arising out of this Membership Agreement, the SelectRebates Intelligent Shopping Toolbar and/or SelectRebates Software, the use of the Site and/or any products and services acquired under or relating to this Agreement shall be resolved exclusively through the use of binding arbitration. Such arbitration shall be subject to the Federal Arbitration Act and the rules of the American Arbitration Association which shall govern such arbitration and be conducted before a single arbitrator in Denver, Colorado. Any claimants shall have their claims/disputes resolved on an individual basis. Class action arbitration is prohibited under this Agreement. Neither you nor we shall be entitled to join or consolidate claims in arbitration by or against other users or arbitrate any claims as a member of a class or in a private attorney general capacity. We will pay the costs of the arbitrator. Except for the costs of the arbitrator, each party shall bear its own costs, including any attorneys' fees. Any award rendered in arbitration shall be final and binding, and may be enforced in any court having competent jurisdiction. In addition to any other remedies, we shall also have the right to seek injunctive relief to protect our intellectual property rights in and to our Site, Cash Back Program, and Toolbar and Software.

This Agreement constitutes the entire Agreement between you and ShopAtHome.com in connection with general Membership in the ShopAtHome.com program and supersedes all prior agreements between the parties regarding the subject matter contained herein. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. No failure of either party to exercise or enforce any of its rights under this Membership Agreement will act as a waiver of such rights. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture, agency or other like relationship between ShopAtHome.com and its Affiliate Stores. Neither the Affiliated Stores nor any ShopAtHome.com Corporate Partner shall have the ability to create obligation on ShopAtHome.com's behalf.
