OFFICIAL RULES
Win the April Fool’s Day Sweepstakes from ShopAtHome.com!
The ShopAtHome.com April Fool’s Day Sweepstakes (the “Sweepstakes”) is sponsored by Belcaro Group, Inc. d/b/a ShopAtHome.com (“Sponsor”). The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.
PRIZES: Two (2) Xbox 360 consoles with Kinect (approximate retail value of $249.99 USD each) (total approximate retail value of $499.98 USD). Odds of winning depend upon the number of eligible entries received.
ELIGIBILITY: The Sweepstakes is open only to individuals 18 years or older at the time of entry who are legal residents of the 50 United States and District of Columbia . To be eligible, an entrant must have access to the Internet, and must have a Facebook account and “Like” ShopAtHome.com on Facebook. Employees of Sponsor, and their immediate families (defined as parents, children, siblings, spouses and grandparents), and those living with any of the foregoing are not eligible. All federal, state and local laws and regulations apply; void outside the 50 United States and the District of Columbia, and where prohibited by law.
TO ENTER: To enter, you must comment on the ShopAtHome.com Sweepstakes blog post between 12:01 A.M. MDT and 11:59 P.M. MDT on April 1, 2012. The ShopAtHome.com Sweepstakes blog post can be found in a link on the ShopAtHome.com Facebook Page. All comments on the ShopAtHome.com Sweepstakes blog post during this time period will be automatically entered. Alternatively, you may enter, without having a Facebook account, “Liking” ShopAtHome.com on Facebook, or commenting on the ShopAtHome.com Sweepstakes blog post, by sending an e-mail to facebook@shopathome.com with your name, e-mail address, and “April Fool’s Day Sweepstakes” in the subject line. All entries, whether via e-mail or via blog post, must be received between 12:01 A.M. MDT and 11:59 P.M. MDT on April 1, 2012. Limit 1 entry per individual.
INELIGIBLE ENTRIES: All entries will be screened by Sponsor, in its sole discretion, for inappropriate content. Entries containing inappropriate content shall be deemed ineligible and shall be destroyed by Sponsor. Multiple entries by the same entrant shall also be deemed ineligible for the prize. You will not be notified of entries deemed ineligible.
WINNER SELECTION: On or about April 2, 2012, a random drawing from all eligible entries will be conducted. The winner will be notified the day after he or she wins via an email from ShopAtHome.com and will have two (2) days to confirm his or her eligibility. Any winner who does not meet the eligibility requirements will forfeit his or her prize. Any forfeited prizes will be retained by Sponsor. In the event of a dispute regarding the identity of the entrant, the authorized account holder of the Facebook account associated with the winning entry shall be deemed to be the entrant, and an entrant may be required to provide proof of such status.
PRIZE AWARDS: The prizes will be awarded within 30 days after winner verification, subject to prize availability. No prize substitution or transfer by winner is permitted. Limit one prize per person. Sponsor reserves the right to substitute the prize with another prize of equal or greater value. All taxes are the sole responsibility of each winner. Sponsor may require that the winner return a signed W-9 form and/or a Winner’s Affidavit and Release to be eligible for the prize.
PRIVACY: Please review the Sponsor's privacy policy at http://www.shopathome.com/pages/privacy-policy.aspx. By entering the Sweepstakes, entrants acknowledge that they have read and accepted the privacy policy, and agree to Sponsor’s collection and use of their personal information in accordance with the privacy policy. Personal information will not be provided to Facebook.
GENERAL RULES & LIMITATIONS: One entry per individual. Entry and acceptance of a prize constitutes permission to use the winner’s name, hometown, likeness, photograph, biographical, and prize information, and entry materials and/or statements about the Sweepstakes for print publication, online posting, and any other promotional purposes without further compensation, except where prohibited by law. Entries become property of Sponsor. By participating in the Sweepstakes, you agree to release the Sponsor, Facebook, and its affiliates, subsidiaries, employees, directors, officers, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use or misuse of any prize. Entries that have been tampered with or altered are void. Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Sweepstakes, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of prizes, or that may limit prize fulfillment or a participant’s ability to enter the Sweepstakes. Sponsor reserves the right to permanently disqualify from the Sweepstakes any person it believes has intentionally violated these official rules. Sponsor reserves the right to modify, suspend or terminate the Sweepstakes in the event that it becomes infected by a computer virus or is otherwise technically impaired or if the Sweepstakes cannot be conducted as planned due to causes beyond the control of the Sponsor. In such event, winners will be selected from all valid entries received up to that point in time. Sponsor is not liable for lost, stolen, misdirected or late entries.
DISPUTE RESOLUTION: Except where prohibited by law, by entering you agree that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or the awarding of the prize, shall be resolved individually, without resort to any form of class action and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Sweepstakes but in no event attorneys’ fees, and you hereby waive all right to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Any action at law or in equity arising out of or relating to the Sweepstakes, or the awarding of the prizes, shall be governed by and construed exclusively in accordance with the laws of the State of Colorado and shall be filed only in the state or federal courts located in Denver, Colorado, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action.
