Win the ShopAtHome.com Coupon Idol Video Contest
The ShopAtHome.com Coupon Idol Video Contest (the "Contest") is sponsored by Belcaro Group, Inc. d/b/a ShopAtHome.com ("Sponsor"). The Contest is in no way sponsored, endorsed or administered by, or associated with Facebook or YouTube.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.
PRIZES: One (1) $3,000 grand prize, one (1) $500 People's Choice award, one (1) $2,000 second place prize, one (1) $1,000 third place prize, two (2) $500 runner-up prizes, and five (5) $100 honorable mention prizes. Total approximate retail value of $8,000 USD. Odds of winning depend upon the number of eligible entries received.
ELIGIBILITY: The Contest is open only to individuals 18 years or older at the time of entry who are legal residents of the 50 United States and District of Columbia (excluding residents of New York, who are not eligible). To be eligible, an entrant must have access to the Internet, must "Like" ShopAtHome.com on Facebook, and must be a registered member of ShopAtHome.com. Judges, employees of Sponsor, and their immediate families (defined as parents, children, siblings, spouses and grandparents), and those living with any of the foregoing are not eligible. All federal, state and local laws and regulations apply; void New York, outside the 50 United States and the District of Columbia, and where prohibited by law.
TO ENTER: To enter, you must submit a video of your original song via upload on www.shopathome.com/video.aspx between 12:01 A.M. MDT on May 2, 2011 and 11:59 P.M. MDT on May 29, 2011 (the "Contest Dates").
ENTRIES: All video entries ("Video(s)") must be: (a) created by you; (b) your original song or remake of the ShopAtHome.com Coupon Idol Video Contest approved lyrics; (c) include the words "coupons" and "ShopAtHome.com" in the lyrics; and (d) in English. The video must not contain material that: (i) violates Facebook or YouTube policy; (ii) contains nudity, pornography, obscenity, indecency or sexually explicit material; (iii) depicts violence, or drug or alcohol use; (iv) promotes hatred, harm, or discrimination against any individual or groups; or (v) is otherwise inappropriate, in Sponsor's sole discretion.
Videos must be in .wmv, .asf, .avi, .mov, .mp4 or .mpg format and cannot exceed 20mb. Videos may be a maximum of one (1) minute video running time, including any credits. Entries longer than one (1) minute are subject to disqualification in the Sponsor's sole discretion.
There is no limit as to the number of people who may appear in or assist with the Video, but only the person who submits the Entry will be considered the Entrant.
ENTRANT'S WARRANTIES AND REPRESENTATIONS: You represent and warrant that the Video is your original work, that you have all right, title and interest in and to the Video, and that you have the right to enter into and provide the license rights granted in this section to Sponsor. You must obtain appropriate releases for every person or location that appears recognizably in your Video, and provide them to Sponsor upon request. You may download a release form on the webpage where these Official Rules are found. You confirm that no portion of the Video uses, copies or is comprised of the copyrighted or trademarked works of any third-party and no royalty or other consideration is due or will become due to any third party arising out of the creation, copying or distribution of the Video. You acknowledge and agree that all right, title and interest including the copyright, trademark and other intellectual property rights in and to the Video shall vest at all times with Sponsor. You irrevocably grant to Sponsor the perpetual, non-exclusive, royalty-free right to use, re-use, edit, change, crop, resize, reproduce, publish, display, distribute and/or otherwise transmit any reproduction of the Video you submit and any picture, likeness, image, representation, negative, transparency, print, digital information, thereto or indicia, in whole or in part derived therefrom, with or without description or attribution, for any and all purposes including without limitation advertising, trade, display, exhibition and editorial use, throughout the universe in perpetuity, in all manner and media including electronically generated images and any other media, now known or hereinafter devised, without limitation whatsoever. You hereby agree to waive and release any right that you may have to inspect and approve the finished product or copy that may be used in connection with the above use of the Video by Sponsor and/or the use to which it may be applied.
INELIGIBLE ENTRIES: All entries will be screened by Sponsor, in its sole discretion, for potential trademark and/or copyright infringement and for inappropriate content or design. Entries deemed ineligible shall not be submitted to the Judges by Sponsor. No notification will be made to you.
WINNER SELECTION: On June 1, 2011, three Judges will select the 10 finalist Videos from all eligible Videos. Videos will be scored as follows: 50% Creativity, 25% Musicality, and 25% Presentation. In the event of a tie, a fourth tie-break Judge will judge the tying Videos using the same criteria as the original three judges. If there is still a tie following the tie-break Judge's scoring, the winner will be determined by a random drawing of the tying Videos. The finalist Video with the most points will win the grand prize, and the remaining Videos will be ranked by their point totals and be awarded the second place, third place, runner-up and honorable mention prizes respectively. The finalist Video with the most views during the Contest Dates will be awarded the "People's Choice" award. The Judges' decisions will be final with respect to any and all matters relating to the selection of the finalists and winners. By participating, eligible entrants agree to abide by and be bound by these Official Rules and the Judges' decisions. The winners will be notified the day after he or she wins via an email from ShopAtHome.com and will have two (2) days to confirm his or her eligibility. Any winner who does not meet the eligibility requirements will forfeit his or her prize and the next-highest scored Video will be made an alternate winner. In the event of a dispute regarding the identity of the entrant, the authorized account holder of the e-mail account associated with the winning entry shall be deemed to be the entrant, and an entrant may be required to provide proof of such status.
PRIZE AWARDS: The prizes will be awarded within 14 days after winner verification. No prize substitution or transfer by winner is permitted. Sponsor reserves the right to substitute the prize with another prize of equal or greater value. All taxes are the sole responsibility of each winner. Sponsor may require that the winner return a signed W-9 form and/or a Winner's Affidavit and Release to be eligible for the prize.
PRIVACY: Please review the Sponsor's privacy policy at http://www.shopathome.com/pages/privacy-policy.aspx. By entering the Contest, entrants acknowledge that they have read and accepted the privacy policy, and agree to Sponsor's collection and use of their personal information in accordance with the privacy policy.
GENERAL RULES & LIMITATIONS: One entry per e-mail address. Submission of a Video constitutes permission to post the Video, as may be edited by Sponsor, on Sponsor's Facebook page, YouTube Channel (www.youtube.com/shopathome) and website (http://www.shopathome.com/). Entry and acceptance of a prize constitutes permission to use the winner's name, hometown, likeness, photograph, biographical, and prize information, and entry materials and/or statements about the Contest for print publication, online posting, and any other promotional purposes without further compensation, except where prohibited by law. By participating in the Contest, you agree to release the Sponsor, Facebook, YouTube and each of their respective affiliates, subsidiaries, employees, directors, officers, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use or misuse of any prize. Entries that have been tampered with or altered are void. Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Contest, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the processing of entries, the announcement of prizes, or that may limit prize fulfillment or a participant's ability to enter the Contest. Sponsor reserves the right to permanently disqualify from the Contest any person it believes has intentionally violated these official rules. Sponsor reserves the right to modify, suspend or terminate the Contest in the event that it becomes infected by a computer virus or is otherwise technically impaired or if the Contest cannot be conducted as planned due to causes beyond the control of the Sponsor. In such event, winners will be selected from all valid entries received up to that point in time. Sponsor is not liable for lost, stolen, misdirected or late entries.
DISPUTE RESOLUTION: Except where prohibited by law, by entering you agree that any and all disputes, claims, and causes of action arising out of or connected with the Contest, or the awarding of the prize, shall be resolved individually, without resort to any form of class action and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Contest but in no event attorneys' fees and you hereby waive all right to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Any action at law or in equity arising out of or relating to the Contest, or the awarding of the prizes, shall be governed by and construed exclusively in accordance with the laws of the State of Colorado and shall be filed only in the state or federal courts located in Denver, Colorado, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action.
